Not a law firm. BreakupLease provides self-help document templates and educational information. We are not a law firm, we do not act as your attorney, and we do not provide legal advice. Your use of this website and our documents does not create an attorney-client relationship.

1. Agreement to Terms

By accessing or using BreakupLease (the “Service”), operated at breakuplease.com (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

2. What BreakupLease Is — and What It Is Not

What it is

BreakupLease is a self-help document preparation service. We provide state-specific legal document templates for renters in the United States who are dealing with a shared lease transition — either leaving a lease or staying through a roommate’s departure.

What it is not

  • We are not a law firm and we do not practice law.
  • We do not provide legal advice or legal representation.
  • We do not guarantee any outcome — including whether a landlord will accept a notice, sign a release, or return a deposit.
  • We do not review your specific situation or give you a legal opinion.

The documents we generate are based on publicly available state statutes and standardized legal templates. They are not customized legal advice for your specific circumstances.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. The Service is available for renters in California, New York, Texas, Florida, and Illinois. Additional states may be added in the future.

4. License to Use Our Documents

When you purchase a document kit, we grant you a personal, non-exclusive, non-transferable license to:

  • Download the documents you purchased.
  • Fill in the documents with your personal information.
  • Print, sign, and send the documents as needed for your specific tenancy transition.
  • Share the completed documents with your landlord, your roommates, or an attorney representing you in your specific matter.

You may not resell, redistribute, publish, or repurpose our document templates for any commercial purpose. All intellectual property rights in the templates remain with BreakupLease.

5. Purchase and Payment

All purchases are processed by our third-party payment provider, Polar (polar.sh), which acts as the Merchant of Record. By completing a purchase, you also agree to Polar’s terms of service.

Prices are displayed in US dollars and are subject to change without notice. Prices on the Site at the time of purchase are the applicable prices for your transaction.

6. Refunds

Because our documents are digital products delivered instantly, all sales are final. We do not offer refunds once documents have been downloaded. If you encounter a technical issue accessing your documents, please contact us and we will resolve it promptly.

7. Personal Information and Privacy

The information you enter into our questionnaire is processed in your browser and stored locally in your device’s storage. It is not transmitted to or stored on our servers. Please see our Privacy Policy for full details.

8. Disclaimer of Warranties

THE SERVICE AND ALL DOCUMENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose;
  • Warranties that the documents will achieve a particular legal outcome;
  • Warranties that the documents comply with the most recent version of any statute (laws change over time).

You are solely responsible for verifying that the documents you use are appropriate for your situation and comply with the law at the time of your use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREAKUPLEASE AND ITS OWNERS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APPLICABLE DOCUMENT KIT.

10. Indemnification

You agree to indemnify and hold harmless BreakupLease and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your use of the documents or Service;
  • Your violation of these Terms;
  • Your violation of any third-party right, including any landlord-tenant law applicable in your jurisdiction.

11. Third-Party Services

The Service relies on third-party providers for payment processing (Polar) and web hosting (WordPress). We are not responsible for the performance or availability of these third-party services.

12. Modifications to the Service

We may modify, suspend, or discontinue the Service — in whole or in part — at any time, without notice. We may also update these Terms at any time. The “Last updated” date at the top of this page will reflect any changes. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any legal action arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
