Your landlord has 30 days. If they act in bad faith, they forfeit the entire deposit.
Under Florida Statutes § 83.49, a landlord who retains a deposit in bad faith loses the right to keep any part of it — including legitimate deductions. But only if you assert the statute in writing.
In Florida, bad-faith landlords lose the entire deposit.
Florida Statutes § 83.49 has a unique remedy: if a landlord retains a deposit in bad faith, they forfeit the right to keep any part of it — including the deductions they could have legitimately made. But only if you demand it in writing.
Florida’s specific rules.
Florida’s deposit statute is unusual: the penalty for bad faith isn’t a multiplier — it’s a total forfeiture. Here’s what applies to you.
Notice period: 15 to 60 days
Florida’s notice period depends on your rent cycle:
Week-to-week → 7 days · Month-to-month → 15 days · Quarter-to-quarter → 30 days · Year-to-year → 60 days.
For month-to-month tenancies, Florida’s 15-day notice is one of the shortest in the country.
Deposit return: 15 to 30 days
If the landlord doesn’t intend to make any deductions, the deposit must be returned within 15 days of move-out.
If they intend to make deductions, they must send an itemized notice within 30 days.
Bad faith penalty: full forfeiture
A Florida landlord who retains a deposit in bad faith loses the right to retain any portion of it — including deductions they could have legitimately claimed.
This is unique in the U.S. Not a multiplier — a total forfeiture.
Certified mail required
Florida requires that certain deposit-related notices be sent by certified mail with return receipt.
Our kit includes certified-mail delivery instructions for every letter.
You’re on the hook for their share
Florida leases default to joint and several liability. If your roommate stops paying after moving out, your landlord can pursue you for the full amount.
Landlord’s written consent required
To be released from the lease, Florida requires the landlord’s written consent. A verbal agreement has no legal effect.
